No cancellation or rescheduling fee will be charged if the mediation is cancelled or rescheduled more than thirty (30) calendar days before the scheduled mediation conference.
A late cancellation fee will be charged if the mediation conference is cancelled or rescheduled within thirty (30) business days of the scheduled mediation conference, or if one or more parties fail to appear for the mediation, and the parties shall be responsible for a late cancellation/rescheduling fee equal to six (6) hours of mediation time plus the administration fee at the mediator’s then applicable hourly rate. Unless the parties agree otherwise in writing, this fee shall be divided equally among the parties.
To avoid the late cancellation/rescheduling fee, the Mediator must receive notice before the thirty (30) day deadline confirming that all parties agree to the cancellation or rescheduling. Notice that cancellation or rescheduling is possible or likely, notice from fewer than all parties, or a failure to timely notify the Mediator shall not avoid the fee.
If one or more parties are NOT represented by counsel, then instead of the rates set out above EACH PARTY is required to PRE-PAY a non-refundable flat fee of 4 hours of the mediator’s then hourly rate, no later than 5:00 p.m. thirty (30) calendar days prior to the scheduled mediation.

If a single-day Arbitration Hearing scheduled on the merits of the case cancels or reschedules within 30 calendar days of the hearing, the parties will be charged 8 hours of the Arbitrator’s hourly rate.
If a multi-day Arbitration Hearing scheduled on the merits of the case cancels or reschedules within 30 calendar days of the hearing, the parties will be charged 8 hours of the Arbitrator’s hourly rate for each day reserved for the hearing.
The cancellation fee applies to all scheduled arbitrations, regardless of when the arbitration was originally booked or confirmed.
